The 120-day problem

Utah gives you 120 days to serve. Every failed attempt eats into it.

Under Rule 4 of the Utah Rules of Civil Procedure, you have 120 days from filing to serve the defendant or your case can be dismissed. It sounds like a lot. Then the address is stale, the server tries twice, the defendant “isn’t home,” and you’re at day 80 with nothing.

Summons questions

What documents do I upload?

The summons issued by the court and the complaint, plus any exhibits and any scheduling notices you want served together. One upload, one price.

Do you serve federal court summonses?

Yes. Federal service rules are similar; our returns are accepted in the U.S. District Court for the District of Utah.

Can you serve multiple defendants?

Yes. Additional recipients at the same address are $25 each. Different addresses are separate jobs.

Will you file the return?

Add “We file the return” at checkout for $20 and we send it to the court.
