Before you start: what you can’t do
No lock changes. No utility shutoffs. No removing doors or belongings. No threats. Any of these is a self-help eviction and exposes you to damages. Utah’s process is fast if you follow it.
The four steps
Step 1 — The notice
Nonpayment: 3-Day Notice to Pay or Vacate. Lease violation: 3-Day Notice to Comply or Vacate. Nuisance, waste, or criminal activity: 3-Day Notice to Vacate. No lease or tenancy at will: notice to vacate with the required period. Month-to-month terminations have their own period. Post it conspicuously or deliver it. Photograph it. The Utah Courts eviction guide for landlords publishes the forms and the current periods.
Step 2 — File the complaint
If the notice expires and they’re still there, file an unlawful detainer complaint in the district court for the county. The court issues a 3-Day Summons. Serve it. The tenant has three business days to answer.
Step 3 — Judgment and Order of Restitution
If the tenant doesn’t answer, you move for default. If they do, the court sets an occupancy hearing quickly. Most landlords who followed the notice rules win. The court issues an Order of Restitution, and the order states how long the tenant has to leave.
Step 4 — Lockout
Only a constable or sheriff can enforce the order. Serve or post the order, wait out the period, then schedule the lockout. Deputies restore possession; you change the locks. Belongings left behind are handled under the order and statute, and we’ll walk you through those obligations before lockout day.
Collecting what they owe
The judgment covers back rent, damages, and often treble damages for holdover. Garnish wages or execute on property with the same constable’s office.
