TERMS OF SERVICE

These Terms of Service (“Terms”) are a binding agreement between you (“Client”) and Wasatch Constables LC (“Wasatch Constables,” “we,” or “us”). Your use of our services constitutes your agreement to these Terms.

When you submit documents to us for process service and agree to these Terms, the Agreement between you and Wasatch Constables is formed, and the term of the Agreement (the “Term”) will begin. The Term will continue for as long as your process service is unresolved or until you or we terminate the Agreement in accordance with these Terms, whichever happens first. If you submit documents for service on behalf of a law firm, company, governmental agency, or other organization, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on its behalf.

Your Responsibilities

By using our Services, you agree to:

  • Provide Wasatch Constables with all legal documents to be serve;
  • Complete all our requests of you; and
  • Remit the agreed-upon fees upon job completion, subject to our Refund Policy.

Services Provided

When you use Wasatch Constables, you request that we deliver legal documents (“Services”) - such as summons, subpoenas, complaints, and other types of documents - to a specific person or entity (“Servee”). For services along the Wasatch Front, we use employees who may be constables, deputy constables, private investigators, or process servers. Each Server provides Services consistent with industry standards, applicable law, and client expectations. Wasatch Constables provides technology and support services to help that happen efficiently.

What You Should Expect the Server to Provide

  • Diligent and lawful attempts
  • Time and geolocation stamped attempt notes
  • Professional conduct and confidentiality
  • Legal declaration of service after completion
  • Timelines and Expectations

Wasatch Constables offers speed options to meet your specific needs. You can expect the following based on what you select, although these may vary depending on court rules, local conditions, or client instructions.

Standard Service:

First Attempt: Within 4 days of Server acceptance
Subsequent Attempts: Every 48-72 hours
Final Attempt: Within 30 days of acceptance
Declaration Finalized and Signed: Within 3 business days of final attempt*

Priority Service:

First Attempt: Within 2 days of Server acceptance
Subsequent Attempts: Every 6-48 hours
Final Attempt: Within 7 days of acceptance
Declaration Finalized and Signed: Within 3 business days of final attempt*

Rush Service:

First Attempt: Same day (if accepted by 3 pm) or by 12 pm the following day
Subsequent Attempts: Every 4-24 hours
Final Attempt: Within 72 hours of the Server's first attempt
Declaration Finalized and Signed: Within 2 business days of final attempt*

Guaranteed Service:

First Attempt: Same day (if accepted by 3 pm) or by 12 pm the following day
Subsequent Attempts: Every 4-24 hours
Final Attempt: Within 72 hours of the Server's first attempt
Refund of service fees if not completed within 12 months of submission
Declaration Finalized and Signed: Within 2 business days of final attempt*

Post Service:

Posting: Within 48 hours of Server acceptance
Declaration Finalized and Signed: Within 2 business days of signature*

*Declaration signature times vary if an original signature is required.

Customized or Other Service

Some jobs may require customized service timelines that differ from what is listed above. These are often based on court rules, legal requirements, and your specific instructions. The expectations are set during your consultation with Wasatch Constables. You can expect that Wasatch Constables will follow legal requirements and agreed-upon timing for:

  • First and subsequent attempt timing
  • Personal vs. substitute service
  • Affidavit preparation and delivery
  • Re-dispatching and Rerouting

To support timely and lawful service, Wasatch Constables may, at its discretion, reroute or re-dispatch a job request to another independent Server under certain circumstances. These include, but are not limited to:

  • Local laws or court rules require service by a public official on tribal land
  • Server unavailability, delay, or non-responsiveness
  • Client instructions or urgent timing requirements
  • Service failure or unsuccessful attempts requiring escalation

In such cases, Wasatch Constables may re-dispatch your request to an independent Server or, where required by law, to the local sheriff’s department or an authorized public entity. You acknowledge that Wasatch Constables’s role is to facilitate this coordination and that service providers—including sheriffs—are independent from Wasatch Constables and responsible for their own conduct, timelines, and affidavit accuracy.
Rerouted or re-dispatched jobs may incur different timelines, documentation requirements, or costs. You will be notified if such changes materially affect your request.

Limitation of Liability

The Parties understand and agree that no party is liable to any other party to this Agreement for any indirect, incidental, special, consequential, punitive, or exemplary damages. In addition, unless otherwise provided by law, the liability of Wasatch Constables is limited to the greater of $5,000 or the total amount of the fees payable to Wasatch Constables for its Services in connection with a Service request.

You agree to defend, indemnify and hold us, our Team, and our subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) that directly or indirectly result from any claims you make outside these Terms due to a “Limitation of Liability” or any other provision.

You also agree to indemnify and hold us harmless from any losses, including legal fees and expenses, that directly or indirectly result from (i) your use of the Service, (ii) your violation of any laws or regulations, (iii) third-party claims that you or someone posing as you did something that, if true, would violate any of these Terms, (iv) any misrepresentations made by you, or (v) a breach of any representations or warranties you’ve made to us.
The terms set forth in Terms of Service are the entire agreement between Wasatch Constables and the Client regarding the subject matter of these Terms of Service, and all other promises, representations, understandings, arrangements, and prior agreements are merged into this Agreement, which may only be modified by written agreement of the parties.

This Agreement, including but not limited to the application, interpretation, construction, and enforceability of its terms, is governed by Utah law, where Wasatch Constables is organized, without regard to its conflict of law provisions.

For all litigation which may be brought, with respect to any controversy or claim, arising out of or relating to this Agreement or any relationship between us, the sole jurisdiction and venue for such litigation will be an appropriate federal or state court located in Salt Lake County, in the State of Utah, and each party consents to personal jurisdiction in those courts.

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

This Agreement is binding upon Wasatch Constables and the Client and their respective legal representatives, successors, and assigns. Any Server providing service of legal documents is a third-party beneficiary to this Agreement.

This Agreement may be executed in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Signatures on the same document or electronic record and counterpart signatures may be delivered via electronic mail or other electronic means (including pdf or any electronic signature complying with applicable state electronic signature law or, if applicable, the U.S. federal ESIGN Act of 2000) or other transmission method and any document or electronic record or counterpart so delivered with an electronic signature shall be deemed to have been duly and validly signed and delivered and be valid and effective for all purposes.

Compliance with Laws

You represent and warrant that your use of the Service will comply with all applicable laws and regulations. You’re responsible for determining whether the Service is suitable for you to use considering your obligations under any regulations like HIPAA, GLB, Data Protection Laws, United States export control laws and regulations and economic sanctions laws and regulations (“U.S. Export Control Laws and Regulations”), or other applicable laws. If you’re subject to regulations (like HIPAA) and you use the Service, then we won’t be liable if the Service doesn’t meet those requirements. You may not use the Service for any unlawful or discriminatory activities, including acts prohibited by the Federal Trade Commission Act, Fair Credit Reporting Act, Equal Credit Opportunity Act, Children’s Online Privacy Protection Act, or any other applicable laws.

You agree to indemnify and hold us harmless from any losses, including all legal fees and expenses, that result from your breach of this section.

No Warranties

To the maximum extent permitted by law, we provide the Service as-is. This means that, except as expressly stated in these Terms, we don’t provide warranties, conditions, or undertakings of any kind in relation to the Service, either express or implied. This includes, but isn’t limited to, warranties of merchantability and fitness for a particular purpose, which are, to the fullest extent permitted by law, excluded from the Agreement.

Changes

You agree that we may change any of the Terms by posting revised Terms on the Wasatch Constables Site. The new Terms will be effective immediately upon posting and apply to any continued or new use of the Service. We may change the Service, or any features of the Service at any time, and we may discontinue the Service, or any features of the Service at any time.

Refunds

Since Wasatch Constables offers non-tangible, irrevocable services, we do not issue refunds, discounts, or credits of any kind, even if Wasatch Constables is unable to complete service-of-process. While we make good faith efforts to complete service-of-process, executing service is not always possible. This may occur due to inaccurate information being supplied by the User; or when we conclude, in our sole discretion, that effectuating service-of-process is too dangerous or risky for our process servers; or when we determine, in our sole discretion, that future attempts to effectuate service-of-process would likely be futile. Even in these situations, Wasatch Constables will not issue a refund, discount, or credit. You are paying for our attempts at service-of-process—not for our successfully executing service-of-process. As a User, you are responsible for understanding this upon initially utilizing our Service and providing payment. Additionally, you will not be entitled to a refund or credit from us should we refuse service, suspend, close or terminate any account of any User, for any reason, in accordance with these Terms.

Notices

Any notice to you will be effective when we send it to the last email or physical address you gave us or when submitted information on our Wasatch Constables Site. Any notice to us will be effective when delivered to us at:
